This document (“Terms”) establishes the rules and conditions applicable to the purchase and sale of products through the website www.gaiapole.com.br, operated by Gaia Pole. By registering or making a purchase on our website, the Customer fully accepts and agrees to the conditions set forth herein, which may be updated at any time at Gaia Pole’s sole discretion.
For the purposes of this document, the following terms shall be understood as:
Customer / Buyer / User: any individual or legal entity accessing the website www.gaiapole.com.br as a buyer, and who may register to make purchases.
Products: all equipment sold by Gaia Pole, including pole dance bars, aerial hoops, aerial rigs, portable stages, flying poles, and other items available on the website.
Custom-made / personalized products: products manufactured according to specifications provided by the Customer, such as custom dimensions, special finishes, or specific configurations that prevent resale to third parties.
Website / Platform: the online environment located at www.gaiapole.com.br through which purchase and sale transactions are carried out.
2.1. To make purchases on the website, the Customer must register by providing true, complete, and up-to-date information.
2.2. The Customer is solely responsible for the accuracy of their registration data and for maintaining the confidentiality of their password.
2.3. Gaia Pole reserves the right to cancel registrations containing false or incomplete information without prior notice.
2.4. In case of misuse or unauthorized access to the account, the Customer must immediately notify Gaia Pole through official support channels.
3. Products and Availability
3.1. All products displayed on the website are subject to stock availability. Gaia Pole does not guarantee continuous availability of any item.
3.2. Product images are for illustrative purposes only. The technical specifications described on product pages shall prevail over visual representations.
3.3. Gaia Pole reserves the right to change prices, features, and product availability at any time without prior notice, always respecting the price and conditions valid at the time of order confirmation.
3.4. Custom-made and personalized products: some Gaia Pole products are manufactured based on Customer specifications (custom dimensions, special models, etc.). In such cases, the Customer will be informed before completing the purchase, and the specific exchange and return conditions applicable to these products are described in Section 7.
4.1. Prices displayed on the website are valid exclusively for online purchases and are shown in Brazilian Reais (R$), including applicable taxes, except for shipping costs, which will be calculated and informed before checkout.
4.2. Available payment methods are those presented at checkout. Gaia Pole may add or remove payment options at its discretion without prior notice.
4.3. For bank slip (boleto) or PIX payments, the order will only be confirmed after payment clearance.
4.4. Installments are subject to the terms and fees defined by the Customer’s credit card provider.
4.5. In case of price discrepancies between the website and other communication channels (social media, email, WhatsApp), the price displayed on the website at the time of purchase shall prevail.
4.6. Coupons and promotions
Discount coupons provided by Gaia Pole are not cumulative with other promotions, campaigns, special conditions, or discounts available on the website, unless explicitly stated otherwise.
4.7. Installment conditions
Installments of up to 12 (twelve) payments are subject to a minimum amount of R$ 80.00 (eighty reais) per installment. If the installment amount falls below this minimum, the system will automatically adjust the maximum number of installments available at checkout.
5.1. An order is considered confirmed only after the confirmation email is sent by Gaia Pole to the Customer’s registered email address.
5.2. All communication regarding the order—including confirmation, invoice, and tracking code—is carried out exclusively via email. The Customer should also check their spam folder.
5.3. Gaia Pole reserves the right to cancel orders in cases of inconsistent registration data, suspected fraud, pricing errors, or stock unavailability, informing the Customer within up to 7 business days and issuing a full refund.
6.1. Delivery times are estimates and are counted from payment confirmation. Custom-made products have an additional production time, which will be informed at purchase.
6.2. Gaia Pole works with partner carriers to ensure product safety during transportation.
6.3. Delivery attempts: carriers make one (1) delivery attempt at the provided address. If the Customer is unavailable, a second attempt may be made upon payment of an additional fee equivalent to 50% of the original shipping cost.
6.4. The tracking code will be sent by email once the order is shipped.
6.5. Gaia Pole is not responsible for delays caused by strikes, natural disasters, transportation restrictions, or other force majeure events.
6.6. Inspection upon delivery – Customer responsibility
Upon receiving the order, the Customer must:
Signing without remarks confirms that all items were received correctly and in good condition.
If fewer packages are delivered than indicated:
Products are designed for self-installation with provided manuals. Gaia Pole does not offer installation services and is not responsible for third-party installations.
6.9. Event planning
Delivery dates are estimates. Gaia Pole does not guarantee delivery for specific events unless expressly agreed in writing. Customers are advised to purchase at least 45 business days in advance.
7.1. Right of Withdrawal – Standard Products
In accordance with Article 49 of the Brazilian Consumer Defense Code, the Customer may withdraw within 7 days of receipt.
Conditions:
Refund will be processed within 7 business days after inspection.
Custom-made or personalized products are not eligible for withdrawal, as they are produced exclusively for the Customer and cannot be resold.
Customers have up to 90 days to report defects. Gaia Pole has up to 30 days to resolve the issue.
8.1. All products include a 90-day legal warranty against manufacturing defects.
8.2. Additional contractual warranties may apply as specified on product pages.
8.3. Warranty does not cover misuse, improper installation, natural wear, third-party damage, or unauthorized modifications.
9.1. Products are intended for sports and artistic use. Customers must follow all instructions.
9.2. Gaia Pole is not responsible for damages caused by improper use or installation.
9.3. For questions, Customers should contact support before use.
10.1. Gaia Pole processes personal data in accordance with the Brazilian LGPD (Law No. 13.709/2018).
10.2. Data is used for order processing, communication, marketing (with consent), and legal obligations.
10.3. Gaia Pole does not sell Customer data.
10.4. Customers may access, correct, or delete their data at any time.
All website content is the exclusive property of Gaia Pole or its licensors and is protected by Brazilian law. Unauthorized use is prohibited.

These Terms are governed by the laws of the Federative Republic of Brazil. The jurisdiction of Joinville, SC is elected to resolve any disputes, with express waiver of any other jurisdiction.
